EXTENUATIING CIRCUMSTANCES POLICY

During the course students may encounter significant personal difficulties that impact on their course attendance. In such cases they may request that the course Director make allowance for such circumstances in line with this policy.

Circumstances

·         In order for personal circumstances to be considered as extenuating they must:

1.    Be outside the student’s control, and

2.    Impact on the student’s study, and

3.    Be sufficiently proximate in time for the circumstance(s) to have a correlation with the impact the student claims.

·         Such circumstances may be:

1.    Long term, such as ongoing disability or illness

2.    Shorter term, such as a one off illness or family bereavement.

·         Where a student claims extenuating circumstances they must bring the circumstances to the attention of the course Director as soon as is reasonably practicable.

·         It is the student’s responsibility to provide such evidence as is required to demonstrate the extenuating circumstance.

·         All information provided will be treated confidentially.

Process

·         All applications for extenuating circumstances must be put in writing to the Operations Manager Georgina Roberson georgina@ilovelife.me.uk

·         Any application should be made within a reasonable time from when the student became aware that the circumstances occurred.

·         The application must set out the reason for which extenuating circumstances are being requested and what action or adjustment the student wishes to see taken.

·         The course Director and the Operations Manager will keep a written record of what has been agreed with the student.

·         This must then be communicated to the student in writing within 5 working days of the meeting or discussion with the student.

General

·         Where an external organisation such as the Yoga Alliance Professionals, British Canoeing, British Stand Up Paddle Association or the International Sup Yoga Academy is verifying or accrediting a course the policy of that organisation must also be adhered to.

·         This is a practical course and students are expected to attend all YWE sessions and failure to do so will result in the student not graduating. Any missed sessions can be made up at a cost of £150 per session for up to 4 hour.

·         Being a SUP yoga teacher is a physically and emotionally demanding occupation. Trainees must disclose any history of physical or psychological ill health in their application to  YWE. Non-disclosure of such information that later impacts on the trainee’s ability to meet the demands of the course could lead to them being asked to leave the course without refund or the teaching certificate qualification not being granted.

·         YWE will not tolerate the following inappropriate behaviour: any trainee being under the influence of recreational drugs and/or alcohol during course training days or when teaching; any form of physical or emotional abuse of fellow trainees, teachers or students. Any such behaviour will lead to automatic disqualification from YWE.

·         Trainees must complete and meet the required standard for all assessment whether written or practical. The penalty for non-adherence to these requirements may be disqualification from the course; this is at the Director’s discretion.

·         Trainees must do their own written assessments. Copying from another student is prohibited.

·         If the conditions of YWE are not satisfactorily met by a student, or if for some other reason the Director feels that a student is not adhering to the ethos of the course, the student will not receive the YWE Certificate at the end of the course and course fees will not be refunded.

Cancellation of Course

In the unlikely even that the course must be cancelled, YWE will give the students seven days’ notice of this impending cancelation. Students will be given the choice of an alternative date or a full refund including their deposit.

Complaints Procedure

What is a complaint?

A complaint is an expression of dissatisfaction, either written or spoken. A complaint can be made by an individual or a group. You may wish to complain if you are not satisfied with the way you have been treated, the service or tuition you have received from YWE or it employees.

Principles of the YWE’s complaints procedure

·         YWE recognises that complaints are an important part of member feedback. All complaints will be investigated fully and fairly. If the complainant is not happy with the result of the response to the complaint, they will have the right to appeal.

·         YWE is committed to ensuring that its services and courses are of the highest quality. The complaints procedure enables YWE to respond clearly and properly to complaints and to know when and why people are not satisfied with its services and courses, so that it can improve them.

Who can make a complaint?

·         This procedure is for anyone who has received a service from the. This procedure does not cover complaints made by YWE’s paid staff or volunteers who need to follow agreed grievance, disciplinary or other internal procedures.

·         Complaints about YWE’s employees should be addressed to the YWE’s Operations Manager Georgina Roberson: georgina@ilovelife.me.uk

Complaints Procedure

If your complaint is about YWE’s staff, course or centre, there are three stages that you can go through to try and resolve the problem. You may wish to involve an advocate, such as your YWE mentor, or friend to support you at any stage.

The three stages are:

Stage One (Informal)

In the first instance it is the responsibility of the complainant to make an attempt to resolve a problem with the tutor or individual concerned.

Stage Two (Formally registering a complaint)

If you are not satisfied with the response you have received at stage one (informal) then you should use stage two of this procedure.

Outline the details of your complaint by e-mailing the YWE’s Operations Manager Georgina Roberson: georgina@ilovelife.me.uk, or by letter to 15 Holly Hill, Bassett, Southampton, SO16 7ES. If your complaint is about the YWE’s Operations Manager, then you need to address it to the Course Director Dr Enrico Tambellini : enrico@yogawithenrico.co.uk  (marked private and confidential) at the abovementioned address. Your complaint will be acknowledged within 14 days. The letter of response will contain the following information:-

Name, address and telephone number of the person who will investigate the complaint

·         What support you can receive during the process of the complaint, e.g. in terms of making information accessible, using interpreters etc. We will aim to investigate the complaint within 14 days. If the complaint is complex or requires more time, then this timescale may be extended.

·         The complaint will be investigated and considered by the Director or Operations Manager. Substitutes may occasionally be made if any of the two are unavailable or are the subject of the complaint.

·         The investigation may involve all or some of the following courses of action, as appropriate to the individual case:-

1.    The subject of the complaint will be asked for their written response and version of events

2.    A meeting between the subject of the complaint and the Panel.

3.    An internal assessment of teaching competence, or an external assessment should this be deemed appropriate.

4.    Further information may be sought from third parties with regard to the background, for example, from other students on a course.

·         You will be kept informed at regular intervals as to how the investigation is progressing and timescales involved. You may also be asked for further information and comments to ensure that the Panel has a balanced understanding.

·         When the Panel has made a decision, you will receive a formal written response to your complaint. The response will include the following information:-

1.    A decision about whether the complaint was upheld or not

2.    The reason for the decision

3.    The redress, if appropriate, which will be offered to you

4.    Any other action that may be taken in light of the complaint

Stage Three (Appeal)

You have a right of appeal against the decision of the Panel. Any appeal must set out reasons why you consider the appeal to be merited. You must lodge your appeal within 14 days of receiving the decision, sending it to the YWE’s Operations Manager or the Director if the complaint is about the Operations Manager.

An Appeals Panel, normally of 2 members, will be convened to consider your appeal. The course Director will be responsible for ensuring the panel is appropriately representative. Panel membership will be restricted to people who have had no previous involvement in the investigation and consideration of the complaint. We aim to complete the appeal  investigation within 14 days and will inform you of any revised timescale should this, for any reason, prove impossible. The decision made by the appeals panel is final.

Members of the Appeals Panel will:-

·         Consider whether the grounds for appeal are reasonable.

·         Read through the necessary paperwork and speak to any relevant individuals involved with the complaint as they consider necessary.

·         Make a final decision.

A member of the Appeals Panel will write to you as soon as possible, to confirm:-

·         the final decision about the complaint.

·         the reason for the decision.

·         the redress, if appropriate, which will be offered to you.

·         any action that may be taken in light of the complaint.

The Course Director and Operations Manager are responsible for the efficient operation of the Complaints Procedure. Responsibility for carrying out investigations of complaints may be delegated to appropriate personnel within YWE, under the authority of the Course Director.

This procedure was revised on 27th December 2020 and will be reviewed on an annual basis.
